Terms of service

The Terms and Conditions as defined here apply to every product offered on the Lakeside Paradise Pro Shop webshop and all deliveries. Every order implies acceptance of the terms and conditions of sale.

Lakeside Paradise Pro Shop's general terms and conditions are governed exclusively by Belgian law.

Definition

Working days are the totality of all calendar days excluding Sundays and statutory holidays.

Purchase and Payment

The agreement between Lakeside Paradise Pro Shop and you, the buyer, is established when you have accepted and fulfilled the terms and conditions set by Lakeside Paradise Pro Shop. The absence of an ordinary signature does not diminish the binding force of the offer and its acceptance.

Lakeside Paradise Pro Shop reserves the right to refuse an order or subject it to additional conditions such as for large orders, orders by minors, incomplete ordering procedures or problems with previous orders.

Lakeside Paradise Pro Shop always confirms the purchase by e-mail. If a confirmation e-mail has not yet been sent, the agreement is not yet in force.

Payment for products purchased from Lakeside Paradise Pro Shop are made by bank transfer, Bancontact or cash on collection.

The seller retains ownership of all goods until full payment is made.

To ensure secure online payment and the safety of your personal data, transaction data is encrypted using SSL technology over the Internet. No special software is required to pay with SSL.

In the event of late payment, Lakeside Paradise Pro Shop is authorised to dissolve the contract with immediate effect or to suspend (further) delivery until you have fulfilled your payment obligations in full.

Delivery and Delivery Times

Although the delivery times given by Lakeside Paradise Pro Shop are approximate, they are also not deadlines. The latest delivery period is 30 days from receipt of the order, except for payment by bank transfer where the latest delivery period is 30 days from receipt of payment.

If you ordered a product that is not in stock, this will be communicated.

Once the products to be delivered have been delivered to the specified delivery address, the risk, where these products are concerned, passes to the buyer.

Different conditions may apply to deliveries abroad.

Lakeside Paradise Pro Shop delivers to all countries in the European Union.

Delivery is made in person, by Post or by Courier service.

You will be informed of the delivery or shipping costs before confirming your purchase. If shipping costs cannot be calculated automatically, this will be stated and/or an indication of the shipping costs will be included.

Product information

Information, images, verbal communications, statements etc. relating to all offers and the main characteristics of the products provided by telephone or e-mail are given or made as accurately as possible. Lakeside Paradise Pro Shop is not liable for advice it provides, printing and typesetting errors on the website or technical data provided by suppliers or manufacturers.

Availability is indicated for each product.

Lakeside Paradise Pro Shop makes every effort to communicate these details correctly, yet there may be occasions when an inability to deliver occurs. This may be due to inadvertent stock errors or products no longer available from suppliers. In these cases, Lakeside Paradise Pro Shop will notify you as soon as possible and propose a solution.

The products offered by Lakeside Paradise Pro Shop comply with legal standards and may be sold online. Lakeside Paradise Pro Shop may include on its website links to other websites that may be of interest or information to the visitor. Such links are for informational purposes only.

Lakeside Paradise Pro Shop is not responsible for the content of the websites linked to referred to or their use.

Reflection period (trial period) and Returns

For all products purchased from Lakeside Paradise Pro Shop, according to the Belgian law on trade practices, information and consumer protection of 12 April 2010, you have a cooling-off period of 14 calendar days.

This period starts from the day after you take delivery or on your behalf. During the cooling-off period, we expect you to handle the goods and packaging with care. There is no right of renunciation if the products are no longer in their original, complete, undamaged condition. Of course, you are allowed to test the product but there must be no signs of use.

If you wish to exercise the right of renunciation, you must make this known in writing or by telephone within 14 calendar days from the day following the delivery of the product. There is no penalty attached to renouncing the purchase and you may do so without giving reasons.

The goods must be returned undamaged, (in their original condition and packaging) within 14 calendar days after receipt. The shipping date counts as a check. 

All enclosed documentation, warranty certificates and packaging materials must be with the return shipment, as well as your bank account number. The direct costs for returns are borne by the buyer. Unstamped or insufficiently stamped shipments will always be refused and returned to sender.

Lakeside Paradise Pro Shop will refund the full purchase price including shipping costs within 30 calendar days of receiving the goods.

If it turns out that the goods were not received in accordance with the terms of the right of renunciation, the purchase price including shipping costs will not be refunded, or not in full. In this case, the product remains your property. At your request, the product can also be reshipped to you, subject to payment of the corresponding shipping costs.

Exceptions to the stipulated provisions are the following:

• If a product is specially made or changed for you, you are logically not entitled to the right of renunciation of seven working days.
• This exception also applies to perishable goods, CDs, DVDs, or other similar products whose seal has been broken or whose packaging has been opened.
• If a product has been visibly worn or otherwise damaged, your right to a refund is forfeited.

Warranty conditions

Lakeside Paradise Pro Shop follows suppliers' official warranty guidelines. Handling of warranty will be at the expense of Lakeside Paradise Pro Shop except for the shipping costs incurred by the consumer to get the product back to us.

Defects

You are obliged to carefully inspect the goods (or have them inspected) immediately upon receipt. In doing so, you must check whether the delivered goods comply with the agreement:

Were the correct goods delivered?

• Do the delivered goods meet the agreed quality requirements or - if these are not missing - to the requirements that may be set for normal use?
• If a visible defect or shortcoming is found, you must notify Lakeside within 14 calendar days after delivery to Lakeside Paradise Pro Shop.
• A non-visible defect must be reported in writing by e-mail to Lakeside Paradise Pro Shop within 2 working days of discovery, but no later than 1 month after delivery.
• The cost of returning goods that do not comply with the description of the offer shall be borne by Lakeside Paradise Pro Shop.

Force majeure

Force majeure includes all external causes, foreseen or unforeseen over which Lakeside Paradise Pro Shop has no control, but which prevent Lakeside Paradise Pro Shop from fulfilling its obligations.

Lakeside Paradise Pro Shop is also entitled to invoke force majeure if the circumstance preventing (further) performance occurs after Lakeside Paradise Pro Shop should have fulfilled its obligation.

During force majeure, Lakeside Paradise Pro Shop's delivery and other obligations shall be suspended. If the period during which fulfilment of the obligations by Lakeside Paradise Pro Shop is not possible due to force majeure lasts longer than 8 weeks, both parties are authorised to dissolve the agreement, without there being any obligation to pay compensation in that case.

Prices

Before checkout, you will be informed of the prices of the goods. All prices are expressed in Euros and include VAT. Shipping costs are stated separately.

If Lakeside Paradise Pro Shop agrees a certain price with you, Lakeside Paradise Pro Shop is nevertheless entitled to increase the price.

Offers are valid while stocks last.

If a price increase occurs after the conclusion of the agreement, you can dissolve the agreement regardless of the percentage of the increase.

Intellectual property rights

The contents of this site, including trademarks, logos, drawings, data, product or company names, texts, images, etc. are protected by intellectual rights and belong to Lakeside Paradise Pro Shop or entitled third parties.

Enquiries and complaints

Complaints or disputes must be reported within 14 calendar days of delivery. If the complaint is found to be justified, our liability is limited to the exchange of the goods. Any liability of the seller is limited to the actual amount paid for the order.

Lakeside Paradise Pro Shop always handles enquiries and complaints within the reasonable period of 7 calendar days.

Disputes

All offers and agreements are governed exclusively by Belgian law, to the exclusion of principles of conflicts of law in space.

All disputes related to or arising from offers from Lakeside Paradise Pro Shop, or agreements concluded with it, shall be submitted to the competent court in Brussels, unless a mandatory provision of law expressly designates another court as competent.

Limitation of liability

The information on the website is of a general nature. The information is not adapted to personal or specific circumstances, and therefore cannot be regarded as personal, professional or legal advice to the user.

Lakeside Paradise Pro Shop makes great efforts so that the information made available is complete, correct, accurate and updated. Despite these efforts, inaccuracies may occur in the information made available. If the information provided contains inaccuracies or if certain information is unavailable on or via the site, Lakeside Paradise Pro Shop will make the greatest possible effort to rectify this as soon as possible.

However, Lakeside Paradise Pro Shop cannot be held liable for direct or indirect damage resulting from the use of the information on this site.
